Elkhart County election workers serve a vital function in the County’s election process.
Elections are dependent upon those who serve in the primary and general election process.
In compliance with both State and Federal employment compensation laws, election workers are classified into two (2) separate groups for tax reporting purposes.
Group 1: Individuals appointed and trained each year to serve as precinct election officers and work only on primary election day and on general election day may continue to be treated as independent contractors and paid by claim.
Group 2: Individuals who provide election services each year to the Elkhart County Election Board, including precinct election officers appointed for early voting, travel board, or in any other capacity, must be established for payroll purposes as an Elkhart County employee.
The County has adopted ordinance number CO-2024-13 which further explains and clarifies the County’s compliance with both Federal and State employment compensation laws. This ordinance is a result of collaboration with the Auditor, Human Resources, Commissioners, and the Clerk’s Office. The ordinance was reviewed by legal counsel for compliance and passed on 04/01/2024.
