Access to Justice

The Access to Justice Center offers Court accepted paperwork that can be filed without an attorney if you are self-represented. If you would like some assistance with your filing, come visit the Access Center in person. The Elkhart County Judges, along with the Indiana Supreme Court, recommend against your attempting to proceed in court without the representation of a lawyer.

Civil Cases and Small Claims

Circuit Court, Superior Court No. 2, and Superior Court No. 5 have jurisdiction over civil cases. The small claims court allows citizens to bring lawsuits in an informal manner and does not require a party to hire an attorney. The small claims court provides a speedy, reasonably inexpensive and uncomplicated means of determining your claim.

Criminal Cases

Circuit Court, Superior Court No. 1, Superior Court No. 3, and Superior Court No. 4 have criminal jurisdiction over felonies, misdemeanors, infractions and ordinance violations according to the filing order listed in the Elkhart County Local Rules.
